Your Rights Under New Jersey Privacy Laws

LexisNexis Risk Solutions Inc. and the LexisNexis Risk Solutions companies in scope of these laws, provide methods for New Jersey residents to exercise their rights under the New Jersey Data Protection Act (NJDPA) (referred to below as the "New Jersey Privacy Laws").

Exercising Your Rights Pursuant to the New Jersey Privacy Laws

The New Jersey Privacy Laws grant New Jersey residents certain rights with respect to their personal information. These rights may be exercised by a New Jersey resident through our online portal, U.S. Mail, or over the phone.

Please note that requests made under the New Jersey Privacy Laws will not apply to data exempt from the requirements of the New Jersey Privacy Laws. Specifically, publicly available data (i.e., data that is lawfully made available from federal, state, or local government records, and data the consumer has lawfully made available to the general public subject to certain exclusions) is exempt from the requirements of the New Jersey Privacy Laws. The New Jersey Privacy Laws also exempt certain data that is subject to the Fair Credit Reporting Act (FCRA), the Health Insurance Portability and Accountability Act (HIPAA), the Gramm-Leach-Bliley Act (GLBA), the Driver's Privacy Protection Act (DPPA) and certain other laws. Additionally, data may be exempt if it is deidentified.

Rights for New Jersey Residents Under the New Jersey Privacy Laws

1. Submit a State Privacy Act Report Request

You may request a State Privacy Act Report containing your personal information collected and sold or disclosed for a business purpose.

The State Privacy Act Report will contain (i) the categories of personal information we collected about you and the categories of sources from which we collected such information; (ii) the specific pieces of personal information we collected about you; (iii) the business or commercial purpose for collecting or selling personal information about you; and (iv) the categories of personal information about you that we sold or disclosed for a business purpose and the categories of third parties to whom we sold or to whom we disclosed for a business purpose such information.

2. Notice of Right to Opt-Out of Sale/Sharing

A Do Not Sell or Share My Personal Information request, sometimes referred to as an opt-out request, will restrict your personal information that is subject to the requirements of the New Jersey Privacy Laws from being processed for purposes of (i) targeted advertising, (ii) the sale of personal data, and (iii) profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning you, if applicable. Our products and services are not linked to tracking technologies utilized through our websites for targeted advertising, and we do not share personal information in our products and services for targeted advertising online.

A Full Opt-Out request will restrict your personal information from being sold to a third party subject to certain exceptions. Separately, we also offer a Partial Opt-Out request option. A Partial Opt-Out request will opt-out your personal information we maintain that is subject to the New Jersey Privacy Laws except for any data we have relative to your occupation or profession, which will continue to be sold to third parties. In any case, an opt-out request will not apply to information that is exempt from the requirements of the New Jersey Privacy Laws. If you have previously opted out but instead want to authorize your personal information to be sold, you may submit an Opt-In request.

When you visit our websites, we sometimes use tracking technologies which may be considered a "sale" of your personal information for targeted advertising. You may request to opt-out of such tracking technologies by utilizing the "Cookie Settings" link on our websites that use tracking technologies for targeted advertising or by sending an opt-out preference signal supported by your device or browser. Your use of an opt-out preference signal will apply only to your device or browser and not to other consumer information that is not linked to your device or browser. Please note this Consumer Portal website does not use tracking technologies for targeted advertising.

3. Delete My Personal Information

In some instances, you may request the deletion of your personal information. Some exemptions apply to the right to deletion.

4. Right to Correct

You have the right to request the correction of inaccurate personal information maintained about you. To submit a correction request, contact us via U.S. Mail at the address below or call us at 1-888-217-1591 to speak to a live LexisNexis Risk Solutions Consumer Center representative.

5. Right to Be Free from Discrimination

You have the right to not be discriminated against in pricing and services because you exercise any of your rights under the New Jersey Privacy Laws.

As a New Jersey resident, you can submit requests pursuant to the New Jersey Privacy Laws for a disclosure, opt-out, opt-in, or deletion online using our Online Request Form. If you submit an online request for a State Privacy Act Report, once we have verified and processed your report request, you will receive a letter in the U.S. Mail with additional information explaining how you can access your report online.

What is the New Jersey Law pertaining to Covered Person?

New Jersey law P.L. 2023, c.113, P.L.2021, c.371 and Section 3 of New Jersey P.L.2015, c.226 (C.56:8-166.1) allow a “Covered Person” to make a request to a business to the effect that the business may no longer disclose or make available on the internet certain personal information of the Covered Person.

Who is a "Covered Person"?

"Covered person" means an active, formerly active, or retired judicial officer, law enforcement officer, or child protective investigator in the Division of Child Protection and Permanency, as those terms are defined by section 1 of P.L.1995, c.23 (C.47:1A-1.1), or prosecutor, and any immediate family member residing in the same household as such judicial officer, law enforcement officer, child protective investigator in the Division of Child Protection and Permanency, or prosecutor.

What data is protected by the law?

The home address and unpublished home telephone number of any Covered Person.

What rights are available to a Covered Person under the New Jersey Law?

Upon notification, and not later than 10 business days following receipt of the request, a person, business, or association shall not disclose or re-disclose on the Internet or otherwise make available, the home address or unpublished home telephone number of any covered person.

May another person make a request on behalf of a Covered Person?

An authorized person seeking to prohibit the disclosure of the home address or unpublished home telephone number of any covered person shall provide written notice to the person from whom the authorized person is seeking nondisclosure that the authorized person is an authorized person and requesting that the person cease the disclosure of the information and remove the protected information from the Internet or where otherwise made available.

Who is an "Authorized Person"?

"Authorized person" means a covered person or any of the following persons hereby authorized to submit or revoke a request for the redaction or nondisclosure of a home address on behalf of a covered person:

  1. On behalf of any federal judge, a designee of the United States Marshals Service or of the clerk of any United States District Court;
  2. On behalf of any covered person who is deceased or medically or psychologically incapacitated, a person acting on behalf of the covered person as a designated trustee, as an estate executor, or pursuant to a written power of attorney or other legal instrument; and
  3. On behalf of any immediate family member who is a minor and who is otherwise entitled to address redaction or nondisclosure pursuant to this act, the parent or legal guardian thereof

What are the impacts of an opt-out?

Please note that the effect of this request may be that certain personal information about you is not available in identity verification and fraud prevention products utilized by businesses or organizations with whom you interact.

Security freezes will be placed based on your state of residency and the customers use case. Based on this information, LexisNexis may not release your report(s) or score(s) derived for those use cases subject to the Fair Credit Reporting Act without your consent or as permitted by applicable law. You should be aware that applying a security freeze to your file may delay, interfere with, or prohibit the timely approval of applications you make for items such as credit, benefits, or insurance underwriting.

Am I required to provide proof that I am a "Covered Person"?

Covered Persons in New Jersey are not required to provide additional supporting documentation at this time.

How can a New Jersey Covered Person exercise their rights under this law with LNRS?

You may contact us as provided below or you may exercise your rights directly online. To effectuate your rights online, you will need to take the following two steps:

  1. Individuals may request to opt-out of having personal information about themselves made available through certain LexisNexis Risk Solutions products and services, in accordance with legal requirements. If you wish to submit an opt-out request, you may do so at: optout.lexisnexis.com . If you are a judicial officer, law enforcement officer, child protective investigator or any other Covered Person submitting your request under New Jersey law P.L. 2023, c.113, P.L.2021, c.371 and Section 3 of New Jersey P.L.2015, c.226 (C.56:8-166.1) please select any one of the following options: I am a public / elected official; I am a law enforcement officer; or, I am a judicial officer. Next, please complete the form to allow us to process your request. Covered Persons in New Jersey are not required to provide additional supporting documentation at this time.
  2. You may place a security freeze on your file which will prevent your information subject to the Fair Credit Reporting Act, such as your credit score, from being released without your express authorization or as permitted by law. If you wish to obtain a security freeze, you may do so on our Security Freeze page. You should be aware that applying a security freeze to your file may delay, interfere with, or prohibit the timely approval of applications you make for items such as credit, benefits, or insurance underwriting.

Can I opt back in?

You may also choose to opt back in. If you would like to opt-in, please contact us as provided below.

A separate letter will be mailed to you with a unique Personal Identification Number (PIN) that you will need in the event that you choose to temporarily or permanently remove the security freeze.
